The Global Strategic Litigation Council (‘the Council’) was founded in September 2021 to empower civil society to advance the rights of refugees and migrants through strategic litigation and legal advocacy. The Council helps advocates and organizations – including those with forced displacement backgrounds – share knowledge, collectively identify priorities, and execute litigation and legal advocacy strategies. In doing so, it aims to support the consistent and progressive development of international law relating to displacement worldwide.
Today, the rights of people on the move – including more than 37.6 million refugees – are under attack around the world. Since its launch, the Council has connected over 500 litigators, refugee leaders, advocates, organizations, and academics from every continent of the globe working to defend and expand those rights.
The Council provides direct support to its members, including on matters such as litigation strategy, coalition building, legal research, brief writing, sourcing expert reports, drafting/reviewing pleadings, and advocacy work. We also run capacity-building training, develop useful resources, and run events and regional networks to build community amongst our members.
The Council also regularly intervenes on international law matters in courts across the world. For example, the Council filed a legal intervention (amicus curiae) in the Constitutional Court of Colombia on a case relating to the mass cancellation of citizenship documents of approximately 42,000 Colombian-Venezuelans. The Council also co-filed an amicus brief in the Mexican Supreme Court with the International Detention Coalition regarding Alternatives to Detention (ATDs).
In 2023 and 2024, the Council is co-convening a series of regional consultations to create knowledge-sharing and collaboration spaces and identify new strategic legal work to support. Each regional consultation is co-convened with members of the Council – NGOs working directly with refugees and migrants around the world. Following each consultation, the Council has established a regional network for members to continue to share knowledge and collaborate on their strategic legal work. To date, these regional networks exist in Africa, Central America & Mexico, Europe and South America, the Caribbean, and South Asia.
In 2024, we intend to keep building upon our core support offer of providing litigation and advocacy support, running training and events across our thematic priorities, and building community amongst our members. We also want to focus our efforts on expanding the Council’s regional capacity and networks and furthering our work on our newest thematic priority, Climate Displacement. EVENTS & Trainings
REGIONAL CONSULTATIONS
The Global Strategic Litigation Council is co-convening a series of regional consultations to create knowledge-sharing and collaboration spaces. The purpose of these in-person consultations is to bring together key litigators, advocates, refugee leaders, academics and organizations working to advance refugee and migrant rights through strategic litigation and legal advocacy in the region.
These events allow participants to build partnerships, strengthen their network, learn new strategies, and discuss and refine a vision for strategic litigation work in their region and beyond. To date, they have taken place in:

- Central America – Mexico City, March 2023 (co-hosted with Asylum Access Mexico)

Integrating Gender, Sexual Diversity and Intersectionality in the Protection of Refugees
In collaboration with Alejandro Gomez from Refugiados Unidos and Meredith McBride from Hong Kong Justice Centre, this workshop explores how integrating gender, sexual diversity, and intersectionality can transform the understanding of refugee protection. Historically, women and LGBTIQ+ asylum seekers have faced significant barriers, but recent legal and policy developments have highlighted the feminization of migration and the impact of gender-based violence as key drivers of forced displacement. Alejandro and Meredith examine evolving legal frameworks and advocacy strategies to strengthen protections for these communities, offering insights into how these advances can drive systemic change.
Utilizing UN Treaty Bodies for Human Rights Litigation
In collaboration with the Office of the United Nations High Commissioner for Human Rights, this training explores how to use the UN human rights treaty bodies’ individual complaints procedures to protect the rights of people on the move, particularly in the context of return and provide an overview of the procedure, showcase relevant jurisprudence, and discuss strategic litigation opportunities to advance the protection of migrants’ rights.

International Protection, Disasters and Climate Change Training
In collaboration with the Refugee Law Initiative and led by Professor David Cantor at the University of London Refugee Law Initiative together with Dr. Beatriz Sanchez, this training covers key conceptual and legal aspects of how international protection rules expressed by refugee and human rights law apply to claims relating to disaster contexts and climate change in the applicant’s country of origin.

Climiglaw Database Beta Launch – with the Global Strategic Litigation Council, Earth Refuge and RWI
The Council has launched the beta version of the Climate Displacement Database, a free-to-access global database collating and summarizing judicial decisions concerning all forms of internal and cross border climate-related mobility. A Climate Dimension: Practical Steps for International Protection Claims
This panel discussion raises awareness about the practical steps being taken to protect those seeking international protection with a climate dimension to their claim. It also provides information about the individual and collective efforts civil society can join to advance the rights of those displaced by climate change. Our Regional Litigator for Africa, Maureen Okoth, was one of the panelists. We co-hosted the event with Refugee Legal Support, Earth Refuge, the Joint Council for the Welfare of Immigrants (JCWI), the International Refugee Assistance Project (IRAP), and the Greek Refugee Council.

9th Annual UNHCR Strategic Litigation Roundtable: Recap.
THEMATIC PRIORITIES
To set priorities and identify issue-based areas of work, the GSLC convenes Working Groups (WGs). Currently, the GSLC’s three WGs focus on Legal Status & Lawful Stay, Detention & Due Process and Climate Displacement.
In 2022, strategy sub-committees drawn from the membership of the Legal Status & Lawful Stay WG and Detention & Due Process WG identified a set of affirmative litigation priorities for the Council’s support and collaboration. These priorities can be found below:
Legal Status & Lawful Stay
- Access to long-term residency status/rights and citizenship
- Discrimination among and between groups of refugees and refugees and other migrants
- Non-refoulement (including extraterritorial application of the norm and broadening its scope via human rights law)
- Rights related to integration (including privacy and family life/unity)
Detention & Due Process
- Detention of children (including family detention)
- Conditions of detention (including medical care)
- Access to legal counsel
- Alternatives to detention (and accompanying conditions and restrictions)
Climate Displacement
We are currently in the process of working with members and experts across the world to co-create priorities and regional strategies in relation to Climate Displacement work. With support of partners, we are also developing a comprehensive Climiglaw Case Database. This will serve as a tool for informed decision making, effective strategy development and more precise advocacy in this vital area of law and policy. The beta version of the database is currently available here.

In the face of the growing climate crisis and the Council’s involvement in a landmark case concerning climate displacement, this blog considers what is required, from States and from civil society, to ensure the protection of all those displaced by climate disasters.

The Council remembers and celebrates the 40 years since the 1984 Cartagena Declaration originally established to address the Latin American refugee crises and continues to remain vital today, urging effective protections for displaced persons amidst ongoing challenges.

The Council makes important legal intervention in a case against the Mexican government demanding the release of all people held in detention centers during the pandemic.

The Global Strategic Litigation Council and a Coalition of Caribbean Civil Society Organisations* intervened in the Inter-American Court of Human Rights’ Climate Change Advisory Opinion Proceedings.
